Hi,

I have questions about my wife & children ILR eligibility date.

I have been living in the UK since 2010. I had a Tier ICT visa.
My Wife & Children (born in India) came to the UK in Apr2019 on a “PBS Dependant” visa.
I got ILR on Nov2020 in 10 years route.
My Wife & Children (born in India) visa changed into “Spouse/Partner Leave to Remain” & “Dependant Leave to Remain” respectively in Jun2021.

When are my wife & children eligible for ILR? Is it 5 years from Jun2021?
Can their previous stay from Apr2019 (as PBS Dependant) be considered for a 5 years route?

My wife & 1st child were also living in the UK from Aug2014 to Sep2017 (“PBS Dependant” visa) and they were 1.5 years away from Oct2017 to Apr2019. Can person be 1.5yrs away for 10yrs ILR route?

Please suggest.

Your spouse needs 60 months under the family route to become eligible for ILR. Any children will settle with her. They cannot qualify under the long residence if they were away from the UK for more than 180 continuous days
