10 Year long residence ILR application Settlement Adult Relative

Hi

I’m just completing my wifes 10 year long residency ILR application, (although the form keeps showing as “Settlement Adult Relative”). My wife has been in the UK since March 2014 initially on the spouse visa (5 year route) and was then switched over to 10 year route in 2017.

I Just have two questions

1.slightly confused by this question “Have you received any Public funds in the UK”
We receive child tax credits, and child benefit. Tax credits is a Joint claim as they wouldn’t accept a single claim whilst I have a partner, this was declared on her previous two FLR FP applications and on both occasions the visa was granted but the question was differently worded. In previous application the question was “Have you or your partner received public funds” to which we answered yes, whereas on this application it states “Have YOU received any public funds in the UK”.
My question is do I say Yes or No to this as I’m the main claimant, although her name is also on the form and it is a joint claim. By answering Yes would this impact the success of the visa application.


2. I’m also now at the declaration screen so almost completed and not once have I been asked to provide B1 English language test (she has passed B1). Is this not required for the 10 Year route? Or have I been completing the wrong form. The only one question asked about English language was
"Have you provided evidence of your English
language ability in a previous application?"
To which I replied YES………as A1 English was required for the spouse visa application in 2013
even if i answer NO to this question it still doesn't request to provide the B1.

Which form exactly are you completing?

It is form SET LR for long residence ilr.

As others on family route visa's have discovered the long residency application (SET LR) instructs those on family route visas cannot use this form.

Use this form if you have lived in the UK lawfully for 10 years continuously and now want to apply to settle in the UK.
BUT
If you are the spouse or partner of someone who is settled and currently living in the UK and you have completed the relevant period of continuous leave in the UK using the 'Family Route', YOU CANNOT USE THIS FORM. You must instead apply using the form Apply to settle in the UK - Partner of a person or parent of a child already settled in the UK.


Instead (after clicking various links) directions are given to this site

here it gives you the option to select ILR via 5 or 10 year route application, which then takes you to the aforementioned "Settlement Adult Relative" apply now page.

UK Visa and immigration never make it easy !

You misunderstood the notice !!! That is only for people who want to apply under the family route ILR. Under the long residence, your current visa route does NOT matter. SET(LR) is the correct form :!:

Am I not under the family route? Originally on 5 year Spouse visa then switched to 10 year partner visa, is this not the Family route visa. Does this notice not apply to me.

A little confused here ..Does this not apply to me, My wife has completed her 10 years under the family route and now wants to apply under the family route for ILR……so going by the above notice we cannot use SET LR

Do you also know if B1 language test is still a requirement as it was never mentioned throughout the entire application.....yet life in the uk was.

I’m also still stuck with the Public funds question

English B1 is mandatory and there would have been a question asking.

Please make sure you are completing set lr and not any other form. It is the simpler route to apply for 10 years long residence.

Yes to public funds quesrion if claiming jointly

I’m new to the forum but I’m glad I found it as it holds vast amount of information regarding immigration matters, the past few days I’ve been reading through other post on this forum and it appears I’m not alone in this conundrum. There are many others who have posted similar questions to mine with regards to which form is correct form for 10 Year ILR application, as a spouse/partner.

I understand SET LR can be used for the 10 Year route regardless of what visa we are on as long as we make up 10 years whilst having been in the UK legally.

But the below statement on the SET(LR) site reads almost as a clause stating, YES apply under 10 year route under any combination of visas EXCEPT…..

So the above form can be used by all applying for Long residency regardless of visa type EXCEPT those on Family Route cannot use it. Please correct me if I’m wrong. I believe most are reading this the way I am hence why many raising this same question.
Being originally on a spouse visa (entering the UK in 2014) then being switched over to a partner 10 year route visa midway. Are both regarded as Private life visa? Does combining both not equate to completing 10 years of private life….i.e Family Route.




Above you’ve stated I may have completed the wrong form “Settlement Adult Relative” and it should have been SET (LR) but in another thread (link below) with regards to the same subject OP was advised he can use SET (LR) but ALSO (and a link was given) the “Settlement Adult relative” form is correct, you said you always forgot the form changes for the 10 year family route. So which is correct

Regarding B1 language test

It states one the ILR Private life page....
You do not need to prove you meet the English language requirements when you apply to settle as an adult on the private life route.

Does this mean if you apply to settle under the 10 year private life route you don't need to take the B1 test. So no English language test, No financial questions, is "Settlement Adult Relative" not the simpler route compared to SET LR

are spouse visas and partner visas considered as Private Life route visas?


Maybe I've got this wrong and missing something
Would appreciate any clarification.

The long residence is NOT the private life route under Appendix Private life. SET(LR) requires to prove English language
Adult settlement is for people applying after 10 years under the 10 year family/private life route ONLY

so which Application is applicable to me?

I'm fully aware SET LR requires B1 and Settlemet Adult Relative doesn't

As I stated above I'm clearly on the family route but above you have stated SET LR is the form I should be completing

Now you have stated its the Settlement Adult Form for those on the private life route i.e me.

Option 1:
SET LR

Option 2:
Settlement Adult relative

You can apply under either so SET(LR) for long residence or Adult Settlement under the 10-year family route. Private life is a separate route for people granted leave under Appendix private Life and does NOT apply here. Ignore the private life route :!:

I've now almost completing the SET LR online Application but again I have not been asked to provide the B1 English language test certificate? Is this not a requirement

not once did it even mention B1 language requirement, the closest question ws
"Have you provided evidence of your English language ability in a previous application?" as said yes (A1 for spouse visa in 2013). Answering yes or no makes no difference with regards to providing B1 certificate

A1 is not enough for ILR. You should answer no and simply upload evidence of the English language (min pass at B1) with your documents. The form may or may not ask as the online system is not perfect

I've now managed to enter the relevant B1 language requirement details within the SET LR Application.
No financial, accommodation or even public fund questions were mentioned......so I'm happy.

I now just hope and pray they don't turn around and say I should have completed the other form (Settlement Adult relative)

SET(LR) form as explained to you multiple times, has nothing to do with your current visa route. No one will ask you to fill a different form
