ILR - Spousal Visa

Hi;
5 year agoo we applied Family route. I've tried to call Home Office with no success.
I would like to apply ILR but at earliest possible date but I am not sure about the date of application.
Below you can see my 2 residence cards can you please advice.

First residence Card: Valid Until: 16/02/2022
Date İssued: 09/05/2019

Second residence Card: Valid Until: 1/09/2024
Date İssued: 4/2/2022

5 years will be complete on 09/05/2024, so you are eligible 28 days before this date (assuming she switched in the UK)

For the spouse route, the qualifying period starts from the visa issue date if the spouse was granted a visa in the UK. Otherwise the qualifying period starts from first date of entry to the UK. This is why CR001 asked you about it

Hi;

I will apply ILR in early MAY. I calculated date of absence and do not have an any absence more thn 180 day a year. WHen applying do I need the provide a lst of all my absences last five years. Thanks

There is no 180 absence limit for spouse visa holders.

You simply declare any absences of two weeks or more in the form.

There is no absence limit on spouse visa route.

CR001 already responded to it.

Thanks for your answer. Sorry I may have sked question wrongly. Five years ago my son (who was under 18 then) an my wife joined me. They applied 5 year route and know it is time to apply ILR. My son is over 18 now I believe that he should apply seperately susing set M. In set M form section 9.11 asking the following:

How long have you lived in the UK? Years Months
Please provide details of any periods of absence of more than 6 months during that time?

Apart from above there is no where in the form about absence list covering whole last 5 years. If it is a must what sort of absence list we shoud provide. Thanks






Whn I was checking Set M concerning absences only part was asking if you were aot

Your son can be included in the same application using SET(M) form. Absences do NOT matter, whether long or short.

1) I understand that I will not include an absence list. Am I right?
2) My son is over 21 currently do you mean that we can apply using single Set M. Does this give us fee
advantage. Currently it is 2880 for each.

2. Correct. But no fee advantage. Each applicant pays the fee.

Thank I understand that there no discount. If we use one application are we going to have fast track advantage paying only once pr like fees why to pay twice? Thanks

Fees are per applicant, for everything, ILR Fee and the £1000 super priority fee is per applicant.

Hi There are two fast track fees 1000£ and 500£. Wha tis the difference ?
After online application how long does it take to get an Biometric appointment?

Super priority vs priority. Only some routes have a priority option.

A separate third party UKVCAS deals with the biometrics appointments, how soon you can get an appointment depends on the appointment availability in a centre you choose to attend. There is not known in advance

Super priority at £1000 is a decision within 24 hours, not a guaranteed service though.

Priority at £500 is a decision within 5 working days and available foe your route anyway.

I am apllying for ILR using five year route I was told that I have to be UK exact day five years ago.
Example: My applicaition: 20/4/2024 But I was not in UK same thay which is 20/4/2023 eill my application refused. Thanks in advance

I have anothet question.. I can apply 10 days before my visa expiration. Whle my documents are in Home Oficce my visa will expire. Will this bbe unlawfull stay or because Home office has my documents will be acceptable?

False. There is no such requirement

Section 3C extends your visa automatically beyond its expiry while the application is pending, if you apply before the visa expiry
