PBS Dependant ILR visa gap of few days

I have recently got my ILR and my husband is currently on PBS dependant visa which is due to expire on 30/09/2024 however his 5 year will end on 20/11/2024. Earliest he can apply for ILR is 28 days before the 5 years end date which is 23/10/2024. He will have a gap of 23 days for his eligibility period if he applies just before the expiry date (if applies on 29/09/2024). Can he apply for ILR before his visa expiry and then delay his biometrics till he becomes eligible? We are trying not to pay 3 years worth of IHS and visa fees just for a 23 days gap. Please advise if this is possible?

Please see the dates below.

PBS Dependant visa first granted Date: 20/11/2019 (as stated on his BRP)
Expiry date: 30/09/2024
His five year as dependant: 20/11/2024
Earliest he can apply for his ILR(28 days before the 5 years): 23/10/2024

Thanks Zimba for sharing this. As my case is only a 23 days gaps can I just apply for ILR and then delay the biometric appointment to the daet when he will become eligible, rather than making an extension application and varying it later? Please advise?
