You are eligible on the 5 anniversary, minus 28 days, of the the date you entered the UK.

Hi Everyone,

I applied for ILR last Friday as a spouse of British Citizen on super priority Service.

I am working in a company who is owned by one of my cousin.

So, Home office asked that if I am related to the directors I said yes.

Now they are asking about CT600 and personal information about Directors and Company. Directors refused to give me that.

I have told Home Office that I am just an employee not a family member of Directors. I sent them my Payslips, P60 etc.

Do you think my visa will be refused?
Thanks

You cannot qualify under category A or B when applying as an employee of a specified company. Instead, you need to satisfy the requirements under category F or G:
Paragraph 9(a) of Appendix FM-SE of the Immigration Rules sets out the definition of a specified limited company as being one where:

(i) the person is either a director or employee of the company, or both, or of another company within the same group; and

(ii) shares are held (directly or indirectly) by the person, their partner or the following family members of the person or their partner: parent, grandparent, child, stepchild, grandchild, brother, sister, uncle, aunt, nephew, niece or first cousin; and

(iii) any remaining shares are held (directly or indirectly) by fewer than five other persons.
Read the official guide: https://assets.publishing.service.gov.u ... rement.pdf

Checkout the section titled: Director or employee of a specified limited company in the UK – specified evidence
There are very specific documents you need to provide and the income will be based on the company's accounting period.

Thanks for your reply.
I was reading about it.
It's under Non-employment income. But I am full-time employed.

Can you please guide me more?

Sorry, what ?? The non-employment section is known as category C NOT category F or G.
Under category F or G, It is clear that if you are an employee of the specified limited company this applies to you !!

Thanks for your prompt reply.
I have:
Evidence of registration with companies’ house (certificate)

Audited Accounts / Unaudited accounts with an accountants’ certificate of
confirmation

Now I emailed HR to send me CT600, The directors are saying we have 100M pounds of turnover around 550 staff we cannot provide personal details.

Is there any way I can handle this situation?

Waiting for your response

I showed you where to look for in the guide. You also can only claim the income matching the accounting period of the company. CT600 or audited accounts are required if you are working for a specified company. You are required to provide all evidence as per the guide or else your application could be refused.
