D Partner (Standard) Visa Eligibility for ILR

Hi all,

I have a second visa renewal this October, 2024.
1) I came to UK on D Partner Standard Visa for 2.9 years on 9th July 2019.
On 20th March 2020 I went to India and got stuck in India due to COVID travel restrictions and returned back to UK on 28th March 2021.

2) Later I went for my first visa renewal on March 16, 2022 providing my 1 year stay in India due to COVID restrictions with a proper letter and my Visa got renewed for another 2.7 years..

3) Absence list from UK in the last 5 years -
March 19th, 2020 - March 27th, 2021 -Due to Covid restrictions stay in India 373 days
May 29th, 2022 - Nov 19th 2022 - 174 days
Nov 23rd, 2023 - April 2nd, 2023 - 130 days

4) Now my Visa is expiring on Oct 16, 2024.
Will my absence in UK is applicable for applying ILR?.

5) As I am unemployed ( My wife is working) What is the minimum balance amount to be maintained in my bank account

Can I apply for ILR after I complete 60 months i.e. July 2024

There is NO absence limit for spouse visa holders.
5) As I am unemployed ( My wife is working) What is the minimum balance amount to be maintained in my bank account
Your wife needs to meet the £18,600pa financial requirement with at least 6 months payslips and bank statements. The is NO 'maintenance fund' you have to maintain.
Can I apply for ILR after I complete 60 months i.e. July 2024
You can apply for ILR, if you meet all the requirements, within 28 days before the 5th anniversary of the date you entered the UK.

So, I don't need to wait until October to apply for my ILR?

I can go after June 15th because July 9th marks as 5 years i.e. completes 60 months.

One more query regarding this.

As I got reply in previous post like this - "You can apply for ILR, if you meet all the requirements, within 28 days before the 5th anniversary of the date you entered the UK"

Does this mean, I don't need to wait until October 14, my visa expiry period to apply for my ILR?

and I can go for ILR after June 12th because July 9th marks as 5 years i.e. completes 60 months.

Your visa expiry is irrelevant. You will be eligible for ILR within 28 days of completing your 60 months
