ILR Query for "Date you first entered the UK"

Hi All,

My partner and I are about to apply ILR together Set-O (5 year route) where I am on a Skilled Worker Visa and my partner is on the PBS dependent visa. We entered the UK in Nov 2018, however my partner left the UK a few times for long periods between Nov 2018 and June 2019. In this case, my partner's 5 years in the UK are counted from June 2019 to May 2024 as they fulfil the criteria for not staying more than 180 days in any 12 month period outside UK. In my case, I don't have any long absences in any period.

In the ILR (Set O) visa form, there is a section with title "Date you first entered the UK", with the statement: "This is the date you entered the UK when the period of stay you are basing this application on started."

I am having a bit of confusion on what to enter here. What should be the date that I enter? Should it be Nov 2018 for both; or June 2019 for both? Or separate ones (Nov 2018 for me and June 2019 for my partner)? I am leaning more towards Nov 2018 as we both entered UK in that month, but the UKVI should consider only the 5 previous years from today (June 2019 to May 2024).

Also should I add the absences after the "Date you first entered the UK" (i.e. Nov 2018 to May 2024) or only for the 5 year period (June 2019 to May 2024)?

The answer to that question is not important at all. Your eligibility is not determined by that at all. You only need to declare absences covering the last 5 years

Thank you Zimba for your reply. I am a bit worried if I entered the wrong date it could jeopardize my application. In the form, both me and my partner (who have different sections in the form) are asked this question separately about the "Date you first entered the UK".

The issue is the qualifying period is June 2019 to May 2024, but we first entered the UK in Nov 2018. Should we put Nov 2018 as this date, or June 2019?

If we put June 2019, I am worried that this may be incorrect as it is not the actual "date of entry", rather the "start of the qualifying 5 year period".

The ILR eligibility ha nothing to do with that date, the immigration decisions are made on the rules not how you feel or what you believe.

You are overthinking this. The ILR eligibility has nothing to do with that date, the immigration decisions are made as per the rules, not how you feel or what you believe. Caseworks know the rules and follow the rules
