ILR Application on Private Life Route (Young Adult)

Hi,

I came to UK as a dependent of my mum back in 7/7/2010, she came 2/2/2010 as a tier 4 student.

I was 12 and my younger brother was 11 at the time of our entry to the UK

In September 2015 our leave to remain was cancelled as my mum's college refused to give CAS, and she went to an appeal.

By end of 2016 the appeal was rejected. Then I applied for Private life route as I already turned 18, and my parents and younger brother made a separate application. It could have been I was an overstayer for a few days before my application.

That application was rejected and with all the appeal it was around mid 2017 when the application ended.

I received a letter to leave the country, and same happened with my parents + brother application.

We then applied again for Private life route and somehow with appeals, we were granted leave to remain on private and family life in May 2019 on 10 year route to settlement as that was the original application that led to the appeal case.

During the extension of the leave, me and my brother was granted extension as young adults on 5 year route to settlement.

Now when we look at ILR requirement for Private life, me and my brother meet all the requirements. We both was granted leave to remain on private life between the age 18-24, came to uk as a child, and lived 5 year continuously on the current leave, plus we both been in the UK for over half of our lives

So now I am applying for ILR and the application ask for whether I was an overstayer. I am concerned whether I should say yes or not.

Previous overstaying has no effect on your ILR
