Hello everyone,

I would really appreciate if you can help me with ILR queries.

I am eligible for ILR as I have completed 5 years and I have 1 more year of valid skilled worker visa until June 2025. My employer will support me with my ILR application.

The situation is bit complicated for my wife, she has been in the UK for 3.5 years as of today on skilled worker dependent visa and her dependent visa is also valid until June 2025.

My question is If I get ILR so what impact it will have on my wife's visa status? and does she has to change her visa status as soon as I get my ILR or her existing visa will work, which is valid for one more year.

Let's say her existing visa is valid so it will be 4.5 years by June 2025 so she will be 6 months short for her ILR application so what she has to do in this case?

There is no impact. She stays under her dependant visa and can even extend her visa, until eligible for ILR

Hi, Thanks for your reply.
I was under impression that mine visa status will change in June 2025 to ILR from skilled worker visa. If she has to apply for visa extension then she has to apply as a ILR dependent visa so her visa status will change from skilled worker dependent to ILR dependent visa, would it be counted as change of visa and her ILR clock will reset?

The fact that you get ILR is irrelevant. There is no need for her to switch to the family route at all as her dependant status can continue without any issues as your ILR will be granted as a skilled worker. She can remain under the dependant route without as explained until she completes the 5 years for ILR.

If the lead applicant has obtained settlement or British citizenship through any route,
other than UK Ancestry, covered by this guidance, a dependant can apply for
permission to stay, or settlement if they qualify, as a dependant on the economic
route, provided they held permission as the lead applicant’s dependant before the
lead applicant settled. This does not apply to children born in the UK before the lead
applicant settled
