My visa is expiring, I can apply for ILR but have a released under investigation. What can I do?

Hi,

This forum has been very helpful when I have been searching for information. I am currently on a visa that is nearing its completion. I am eligible to apply for ILR but I was arrested (for false allegations) and put under released under investigation (RUI) for a while. I have not heard any updates. What can I do?

Do I need to declare RUI in an ILR application? I have not been charged for anything

If I apply for ILR or any new visa does it mean my application will be paused?

What should I do given that my current visa is nearing its end date?

Any advice is much valued from this forum

What is your immigration history ? Being 'released under investigation' will certainly prevents yo from being granted ILR

Apply before expiration of current leave to ensure you have continued leave. The application will most likely be put on hold/paused till the outcome of the investigation.
However this ensures you have continued legal stay despite expiration of current leave while the investigation is ongoing.
Decision of application afterwards depends on outcome of investigation.

So if I apply it would just be put on pending?

Under the application, is RUI needed to be declared since there is no charges?

Also any one have any good recommendations for lawyer or application advisors on such matters to possibly seek?

What is your current visa ?? What is your full immigration history ?? You are strongly advised not to apply for ILR
