Settlement (ILR) Private Life Young Adult (Half-Life)

Hi,

I arrived into the UK as a minor child aged 11 on a visitor visa and remained in the UK ever since. I was granted permission to stay in the UK in 2019 aged 24 Years under paragraph 276ADE(1) (v) on the 10 year private life route as I was aged above 18 years and was under 25 years and had spent half of my life residing continuously in the UK. Please see the decision letter below:

I further extended my leave on the same private life grounds and was granted extension in December 2021 until June 2024. Please see the decision letter below:

I believe I am now eligible to apply for Settlement (ILR) under the New Appendix Private Life on the basis of my private life as a young adult who met the half-life test and has now lived in the UK for a continuous qualifying period of 5 years.

Can someone please direct me to the correct online form and share the link :)

There is a different way to apply if you’re:
  • under 18
  • between 18 and 25 years old, and came to the UK as a child
  • currently in the UK as a dependant on a parent’s visa and you’re over 18
Apply online for indefinite leave to remain as a child. >
You can also use this form to apply to settle in the UK if you are a child on the private life route either as a child born in the UK, or who has or had permission on the private life route based on a qualifying period of 5 years.

Thank you for your response but I’m still not sure which application form is applicable to me. kindly clarify & confirm which of the following two I should use:

+ Adult Settlement Private Life (Over 18) - Online Form - https://visas-immigration.service.gov.u ... 1717848024

Clearly states "You can only use this form if you are over 18 and are applying in the UK. You can apply to settle in the UK after 5 years if you were first granted permission on the private life route as a child or as a young adult (aged between 18 and 24) and you have lived in the UK for more than half your life. If you are aged under 18 and are applying to settle on the basis of your private life, you must apply on a different form. Any other person with permission on the private life route can apply to settle in the UK after 10 years."

From my understanding of the above, this is the relevant form that applies to me as I am over 18 at the moment and have completed 5 Years on Private Life Route and was first granted permission on the private life route as a young adult in 2019 aged 24 and have lived in the UK for more than half my life, kindly confirm.


+ Child Settlement Private Life (Under 18) - Online Form - https://visas-immigration.service.gov.u ... ment-child

Clearly states " You can also use this form to apply to settle in the UK if you are a child on the private life route either as a child born in the UK, or who has or had permission on the private life route based on a qualifying period of 5 years."

From my understanding of the above, form doesn't apply to me as I am no longer a child although I was first granted permission on the private life route as a young adult in 2019 aged 24 and have lived in the UK for more than half my life, kindly confirm

While completing the online application, I have come across the following question:

My 1st Application on Private Life was submitted in September 2018 and my age was 24 Years & 10 Days.

My first grant of permission on the private life route was in May 2019 and my age was 24 Years & 9 Months - under paragraph 276ADE(1) (v) on the 10 year private life route as I was aged above 18 years and was under 25 years and had spent half of my life residing continuously in the UK.

Can you please advise if I should select Yes or No to the above question?

You should select NO. This will not change your eligibility for ILR

Kindly also help me with the following last question outstanding in completing the online application:

In April 2023, I opted to attend a National Motorway Awareness Course instead of receiving a Fixed Penalty for Exceeding a Variable Speed Limit, thereby avoiding a fine & penalty points on my licence.

I would appreciate your guidance on the following:

1. Should I declare the completion of the National Motorway Awareness Course in the above section of the online application? If so, could you please advise which category from the provided options in the screenshot I should select?

or

2. Should I select the last option - No, I have never had any of these. And just mention the National Motorway Awareness Course in my cover letter?

These courses don’t count as a conviction or fine and don’t need to be mentioned, not even to your car insurance.

Along with completion of National Motorway Awareness Course, I have also received the following three PCN’s since I started driving:

1. Parking Eye - Parking Charge Notice - For parking on private property - Fine Paid

2. Parking & Property Management Ltd - Parking Charge Notice - For parking on private property - Fine Paid

3. TFL - Penalty Charge Notice - For parking on the Red Route - Fine Paid

Do I declare any of the above?

No. PCNs do not need to be declared at all unless you appealed them in court and lost.

FYI
A Penalty charge notice (PCN) issued by a local authority is very different to a Parking charge notice (PCN) issued by a landowner or parking company on private land (e.g issued by a supermarket, etc). Only failure to pay the first one is a criminal offence. The other one is just a demand for a fee from a private entity and it is a civil matter
