Hi, I have just joined this forum. I need some guidance on my case.
Here is my case summary
I came in UK as a student in 2011. In 2016 my extension application was refused. Finally I applied asylum in January 2019. I have to wait three and half years and my final interview was in July 2022, where home office granted me 5 years leave to remain as refugee. During this three and half years waiting time I asked my MP to inquire home office and they replied
(i am sorry that MR ___ has not received his substantive interview in relation to his asylum claim. We will take into account the length of of time since he applied and any changes to his personal circumstances during the period until his claim is determined).
Now i emailed them that I was told that that lengthy waiting time will be accounted and if so can i apply my ILR before 5 year. Home office said that we cannot backdate your ILR date and that I have to wait complete 5 years again to be eligible. My question is they promised and even emailed my MP that this lengthy waiting time will be accounted so why cant give me relaxation in ILR time. Has anyone gone through this situation and what are my options.

They do not seem to have ever suggested that such a period would somehow be considered lawful residence. Immigration decisions are not based on promises. You are required to meet the requirements as per the rules in place. It looks like you had no lawful status between 2016 and 2022. You need 5 years of lawful residence to be eligible for ILR
