ILR- Applying to extend PBS dependent visa

Hi,

I got my ILR in October 2023 but my wife is still on PBS dependent visa. Her visa is going to expire in September 2024. She hasn't completed 5 years in the UK so she needs to extend her visa as a PBS dependant.

I was filling out her application, but some of the questions were confusing, so I'm looking for help. Many thanks in advance.

1. I have ILR now so what should I answer for the below question? Also, there is no question related to if the husband has ILR or British citizen.
People applying with you: Does <Husband> already have their Skilled worker visa?

2. Can she apply for 2 year visa as she already completed 3 years and 6 months and she will be eligible for ILR after 1.5 years?

3. While filling out her IHS forms, it asks for my visa expiry date. If I put the current BRP expiry date as 31/12/2024 (because BRP is being phased out by the end of 2024) then it asks to pay only 517.50. It doesn't seem to be fine because it is only for 6 months IHS fee. What should I do in this case? What should we put in to get the 2 or 3 years visa?

If you were previously, for example, a Skilled worker, immediately prior to ILR, then

1. Answer the dependant questions as if the lead holder is a Skilled worker.
2. Unlikely, as SW 36.1.(b) grants 3 years leave.
3. Put a date 3 years in the future.

There may also be a possible (yet untested?) alternative.
