ILR for my child less than 5 years in UK

Hi,

Sorry if this is already discussed but i struggled to find the answer elsewhere in the forum.

I came to Uk on 2019 in tier 2 visa and got ilr on early 2024. My husband joined me after 6 months in 2019 and he recently received his ILR. Our son was born in India before me moving to UK and he joined me as a dependent after 6 months of my partner coming here. We were under impression that anyone would require 5 years of stay in UK to get ILR so havent
Included him in my partner’s application. I think we made
a mistake by not including him. Can we use https://visas-immigration.service.gov.uk/product/set-f to apply visa for
My kid now as both me and my partner have ILR? My kid is 6 years old. We plan to take citizenship after 1 year and our kids current visa expires on Feb

Yes, you made an error by not including the child. Children do NOT have a minimum residence requirement for ILR and they can settle when both parents settle. SET(F) is indeed the right form to use now

Thank you for responding. Is there a direct route for my son to be a citizen without ILR. Considering i will be eligible for citizenship in jan 2025 and his visa is till Feb 2025 ? My Spouse will only be eligible for citizenship by July 2025.

Non-UK born children are expected to have ILR and can only be registered when one parent is British and the other one is at least settled.

Thank you very much. I will apply via the link above. Sorry to be annoying just last couple of questions. The payment at the end only gives me 2 options normal priority which is 6 months and super priority which is a £1k more. The priority service that is £ 500 more that we used for my spouse is currently missing.

The application said that i need to submit 2 declarations form since i planned to keep my spouse as one of other sponsor. Does that mean both me and my spouse need to sign part 1 separately and one part 3 consent from my spouse as he is additional sponsor ?

I do not think there is a normal priority option available for that route, only the two you saw are.
You just need one consent form. One of the parents signs part 1 (on behalf of the child). That is it. Parts 2 and 3 are not relevant here
