Goodafternoon everyone,

I need advice / help in regard to follow response letter we received today after written complaint after 10 months of submitted ILR application. in my complant I requested emergency travel as elderly mother health problem. this response is very confusing. My orgnail application is FLR(DL) with category of settlement and paid ILR.

details my application as follow

type of application : FLR (DL)
category of leave applied : settlement
Date of application :04/09/23
Bio date : 22/09/23
1ist complant : in Aprila,24 (by phone)
2nd complaint: in 23 July,24 ( by phone then email as need emergency travel)


resopnse received :31July,24.

FLR(DL) may not lead to ILR, if you do not qualify. The letter above suggests they granted yet another extension.
How long have you spent on discretionary leave in the UK ?

i spend more 10 years. i got it on jul,2013 and current extion is valid till 08/10/2024.

i lived lawfully more then 10years. upon my application i selected settlement on basis of 10year/120months). and paid fee for £2404. there was no communication till this after my 2nd complain. and if they granted extension then there no expry date given as normal they mention early every extensions.

yes .read this all before submitting my application. once i completed 120months(10years) i gave an other month to apply. last extension i applied in oct,21 and granted last extension on april ,22 which is valid until oct,24. there is no refusal mentioned.

as i mentioned this july i completed 11 years. they grant me DL on july,2013.

I assume that there are no criminality or exclusion issues?

If there was no right of appeal nor right of administrative review, then, perhaps when you return from visiting your mother, request a reconsideration. Politely ask them to consider and follow their Granting settlement Guidance?

Where an individual has held DL for a continuous period of 10 years and continues to qualify for DL under the policy, they should be granted settlement unless there are any criminality or exclusion issues. See Criminality and Exclusion section.

thanks for reply. there is no criminality or exclusion issues. everything clean. I had feeling that they issued me a temporary grant this due emergency travel to visit my mother as I requested in my complaint email with mothers’s medical documents.

and there is decision on my original application. even there is no reply or decision on wife and daughter applications we submitted individually after my submission.
