Applying for ILR with a police arrest, not charged (yet?) but on released under investigation

Hi

I have been arrested a while ago where I was put on bail and then released under investigation. I have not been charged yet. In applying for ILR I see this section of ''Convictions and Penalties'. In this section there is a bunch of options where I think the one that seems most relevant to me is "“An arrest or charge for which you are currently on, or awaiting trial”.

Does a released under investigation count as an arrest I am currently on?

Because in the next section if I tick yes here is:

"Why were you arrested and charged?"
"Give more detail including arrest date, charge date and any court dates"

I think that I am under investigation for alleged offences not charged. How should I proceed with my ILR application?

Declare it in that section. Your ILR will be held until the investigation is over
