ILR APPLICATION REFUGEE

Hi All,

I have been granted refugee status by home office in February 2021 but this is after tribunal hearing held mid December 2020, I have entered UK January 2019 and now im wondering when should I apply for ILR?

I remember I was told that if application is granted by court that means I have been considered refugee since first entry so that means I could have applied last january (2024) but on the basis of HO grant date I still need to wait till February 2026, which is right? does having a child born in UK changes anything in the equation ?

The UKVI apparently disagree with what you were told.

Qualifying period (STP 3.1)
The applicant must have spent a continuous period of at least five years in the UK with either:
  • (a) refugee status; or
  • (b) humanitarian protection.
started when they granted your permission to stay.

Apply
You should apply during the last month of your current permission to be in the UK
.
A UK born child will also be entitled to register immediately after they grant your ILR.
