ILR Dependent Application Made under Wrong Route

Hi All - hoping you can help. My wife is staying with me in UK since 2019 and I have extended Tier 2 dependent visa twice. Considering its been more than 5 years, we have applied for ILR under Set O but iI have got the below email from home office today.

You are applying for Settlement under Tier 1 Dep Partner Joining Relatives – ILR but our records show you have previously been granted permission to stay/leave to remain under the Tier 2 Skilled Worker – Dep Partner Joining Relatives visa route.

You have therefore applied for Settlement under the wrong route.

Could you confirm you wish to pursue your current application as you have not completed the correct form and this does not meet the immigration rules or if you wish to vary your application and apply under the correct route. I believe you should apply as a Tier 2 Dependant spouse Migrant applying for settlement.


Please can you suggest what I need to do ? I believe in error I selected Tier 1 or Global Talent Dependents as the visa category whereas I should have selected Tier 2 Dependent category but the email from home office seems to suggest I have not completed the correct form which has confused me.

I came to UK under Tier 2 General visa in 2016 and got my British citizenship last year.

You should apply again and choose the correct route

Thank you Zimba, I will re-apply.

Is this the correct category to apply ILR on Set(O) -- (a) Skilled Worker, Tier 2 or International Sportsperson dependant

Also, do you know why the caseworker has stated that my form is incorrect. I believe my form is correct that is Set (O)

Yes, that is the one. SET(O) covers many separate routes. So choosing the wrong route means you end up filling a wrong form from their perspective
