ILR Query

Hi everyone, this question is on behalf of someone currently holding a spouse visa - expiring in 3 (THREE) days - but who has also now reached 10 years of continuous residence in the UK.

They recently separated from their partner and are unsure whether they need to switch to a different visa category or if they can still apply for Indefinite Leave to Remain (ILR) based on their 10 years of residence, even after the separation.

They also have a British child who lives with them full-time, so they would switch to a parent visa if needed before applying for ILR.

Should they switch to a parent visa first or go ahead and apply for ILR? Any advice would be greatly appreciated!

They should apply for ILR under the long residence route directly using the form SET(LR)

Just to clarify and confirm, will there be any issues when he applies for ILR with his current partner visa, even though they are no longer together?

Under the long residence, you will need to apply on your own and qualify on your own
