Dependent visa on Tier 2 General - Now applying ILR

Hi all,

I hope someone can kindly provide advice regarding my ILR application.

I came to the UK on a Tier 2 Dependant visa when my husband was on a Tier 2 General visa. I have now completed 5 years on the dependant visa.

Two years ago, my husband switched to Indefinite Leave to Remain (ILR) and is currently applying for naturalisation.

I meet the requirements for ILR under the 5-year dependant route and am preparing to submit my application. Could you please advise:

Which online application form should I complete in this scenario?

"Skilled Worker, Tier 2 or International Sportsperson dependant"?
Or
"Family route" of a settled person?

is it better if my husband submit his naturalisation application before I submit my ILR application?

Apply using SET(O) under "Skilled Worker, Tier 2 or International Sportsperson dependant". The family route is ONLY for people who held 5 5-year visa under such route and NOT as dependants. Your husband's naturalisation has no relevance here.

Thank you very much for your reply. I am asking the above information because there is a question in the form that says, 'Which visa is your name of my husband applying for or has been granted?' The drop down menu has different options like Tier 2 (General_ visa), skilled worker visa etc. but no option like ILR..

Your ILR will be based on the previous immigration route of your partner, not the fact that they have ILR now

Thanks again for reply. Applying for Indefinite Leave to Remain (ILR) under the 5-year dependent route (SET O) based on a Tier 2 General or Skilled Worker visa required to demonstrate Professional, Family, and Social Life as part of the application or need to describe in covering letter? I hope this might be my last question regarding this application.

I have another question please and I would appreciate your advice. Upon checking my passport regarding my return to the UK after a one-month absence, I noticed that there is no entry stamp from the UK airport.

Could you please advise how I can obtain this information? i believe obtaining this UKVI will further delay my application and my leave to stay will be expired by then. I do have my travel tickets and the exit stamp from my home country after the visit, but the UK entry stamp is missing.

This is a non-issue. UKVI relies on their systems to view your exit and return to the UK, not just your passport.

Also, section 3C automatically extends your lawful residence after your visa expiry date.
