Covid case - Advice on ILR file date

Dear All,

I hope you’re doing well.

I am in a tricky situation and would greatly appreciate your advice regarding the date I should consider for my ILR application based on the following scenarios:

I was in the UK as a dependent on my husband’s visa, later traveled to India to file the Skilled Worker visa offered by my organisation.

My UK Skilled Worker visa was stamped for the first time on 19th March 2020, but I couldn’t travel due to the COVID-19 lockdown in India. During this period, I was worked remotely for my uk employer while stranded in India.

My UK Skilled Worker visa was stamped again on 15th August 2020, and I traveled to the UK, landing on 24th October 2020.


Given these circumstances, and with evidence (e.g., return tickets) showing I intended to travel earlier but was restricted by COVID regulations, which date should I consider when filing my ILR application?

Should I consider 19th March 2020 or 15th August 2020? Please help me to understand.

Your advice would be invaluable.

Your qualifying period starts from 19th March 2020 when your first visa was issued.

Thank you so much for confirmation. I would also like to know when the earliest can I file my ILR application.

28 days before my:

1. Application submitted to Home Office: 10th February 2020
2. Biometric Appointment: 27th February 2020.
3. Visa stamped date: 19th March 2020.

I’m trying to find out from above dates which earliest date should I consider to file my ILR application.

The earliest date of ILR eligibility is within 28 days of completing your 5 years. The date of application is NOT critical
