Documents and evidence required for SET(O) ILR

Hi All,

I brother is submitting ILR for his wife and my brother is British citizen, and his wife is dependent on him and has visa category as Spouse / Partner Leave to Remain.

Query: He need to use SET O Form for his wife to submit the ILR? If yes, then it asking for below info and there what needs to be selected?

"Select a category in which you are applying for indefinite leave to remain.
(Required)

Tier 1 or Global Talent dependants

Tier 1 migrant

Skilled Worker, Tier 2 or International Sportsperson dependant

Skilled Worker, Tier 2 or International Sportsperson

Bereaved partner

Note: If it is "Other purposes or reasons not covered by other application forms" then what write should be written in the text box?

Did his wife come to the UK under the spouse/family route ?
How did your brother become a British citizen ?

Yes she came via Family route Her Visa category is Spouse / Partner Leave to remain and their last extension was done by solicitor as TYPE OF VISA / APPLICATION: Family Route

My brother became British citizen after ILR.

Hi - Any suggestion on this? does this to be SET(O) or SET(M) he has to fill the application?

If the spouse has spent 60 months under the spouse/family visa then SET(M) is the correct form

Thanks, even for the Kid same ST(M)? N.B: They both (My brothers wife and Brother child) came to UK in 2019

Child Visa Category is : dependant Leave to remain.

So they were NOT under the dependent route like the skilled worker dependant route etc ?

Solicitor who has submitted their file his office closed permanently. There Visa category (which written on BRP)

My Brothers Wife: LEAVE TO ENTER (Valid from 03-10-2019 till 10-07-2022) and they renewed and her Visa category: SPOUSE / PARTNER LEAVE TO REMAIN ( Valid from 28-08-2022 till 02-03-2025)

My Brother Daughter: LEAVE TO ENTER (Valid from 03-10-2019 till 10-07-2022) and they renewed and her Visa category: dependant Leave to remain ( Valid from 28-08-2022 till 02-03-2025)

Note: When his family came first my brother was on ILR visa and in 27 June 2022 he got the British passport.


How to know they have spent 60 months under the family route from above?

If they got their visas after your brother got ILR, then they are under the family route

Yes my brother was having ILR since 2015 and he got married in 2017 in India and had baby in 2018 Oct and then he applied for Visa for his wife and daughter . So yes they got the visa after he had ILR.

So in that case is it SET (M) form for both of them (his wife and daughter)?

Hi,

I have started filling application for brothers wife and child (minor - 7 years old) and have following doubts.


1) In Child form there is question "Are you and your partner married or in a civil partnership?" i presume they asking for the child not for the parents? If yes then its answer should be "No" as she is child.

"Spouse / partner details
Are you and your partner married or in a civil partnership? No"


2) In Finance section they asked about "Non-employment income"

Finance
Add non-employment income in the name of:Mr XXXX XXXXX
What is the source of the non-employment income?: Dividends or other income from investments, stocks and shares, bonds or trust funds
Bank or building society name the income is paid into: Lloyds Bank
Bank or building society account number the income is paid into: XXXXX
What amount did Mr xxxxxx receive (in GBP) from this income source in the last 12 months?: £XX.00


Documents I will provide to prove non-employment income from dividends for Mr XXX XXXX

A certificate showing proof of ownership and the amount(s) of any investment(s)
A portfolio report (for a financial institution regulated by the Financial Conduct Authority (and the Prudential Regulation Authority where applicable) in the UK) or a dividend voucher showing the company and person’s details with the person’s net dividend amount and tax credit
Personal bank statements for or from the 12-month period prior to the date of application showing that the income relied upon was paid into an account in the name of the person or of the person and their partner jointly
Evidence that the company is not a specified limited company as set out in Appendix FM-SE, for example, the latest Annual Return filed at Companies House


My Brothers own a building construction company and he is director there, so what should be the income in GBP and from where and how to calculate that?

1. Any question about the partner is regarding the parents

2. For a director of a company of self-employed people the correct option is NOT the non-employmnet category. That is category C.
A director of a business must apply under category F or G. You also do not need to declare sources of income you do not intend to use.

Checkout the section titled: Director or employee of a specified limited company in the UK – specified evidence

If you are working for your own company (or your spouse's company), that is called a specified company under the rules. There are very specific documents you need to provide and the income will be based on the company's accounting period.

In the finance section it asks for

"Additional sponsored children
Is your partner currently sponsoring any additional children?
You should tell us about any additional children they are sponsoring who need a different type of visa to enter or remain in the UK
Do not include children who are:
dependants applying on this application
over 18
British Citizens
settled in the UK
EEA nationals with a right to reside in the UK under EU law"

My Brother have 2 daughter and they are British citizen so i don't need to mention that as it says "Do not include children who are - British Citizens"

British children are not being sponsored and should NOT be included

Thanks, also just want to check, once my brother's wife and his daughter gets ILR, are they eligible to apply for British naturalisation straight after they get ILR or need to wait for 12 months?

His spouse can apply to naturalise and the child can be registered using form MN1
