Delayed entry because of Covid

Hi there,

I have some confusion in applying my ILR.

I was on ICT dependent visa pre covid and travelled to India on March 2020 to apply for visa switch to skilled work visa as I got sponsorship from my company.

Once my visa appointment was done and submitted my passport the covid lockdowns were established and I received my passport and travelled back to UK on September 2020 as there were no VFS functioning and flights were not operated.

The problem I am facing are with the date I entered UK and my skilled work visa expiry date.

Entry date to UK - 21/09/2020
Vignette date - 09/09/2020
Skilled work visa expiry date - 03/05/2024
Start date in BRP - 24/03/2020

If I consider the entry date I have to apply ILR on September 2025 but my skilled work visa is expiring on 03/05/2025. There is no mistake from my side I could not travel because of covid restriction and VFS was also not functioning at that time and my visa expiry is unfortunate.

I have proofs for lockdowns established, cancelled flight tickets and enquiry E-Mail which I sent to VFS, if I apply my ILR on April 2025 is there chances of my ILR application getting processed successfully?

The date of entry is irrelevant. You will be eligible around the end of Feb 2025 which is within 28 days of completing your 5 years (counting from the first visa issue date). It seems you have an absence period of less than 180 days so you should be able to apply as normal in Feb

Thanks for your response but my Visa stamp date - 09/09/2020 can I still apply on Feb 2025?

Yes you can. That is NOT your first visa approval date.

Hi,

I am in general tier2 visa currently. I have problem with my visa start date in my BRP and eVisa

BRP - 24/03/2020
eVisa - 09/09/2020
eVisa expire - 03/05/2025

When I raised this with home office they said as per home office records eVisa date is correct.

Which date should I consider for applying ILR?

Ignore eVisa. You have been advised on this before. This should not be repeated over and over again

Thank you the confirmation. In my previous post I didn't mention about eVisa dates so I thought of checking it with you. Its much clear now.
