query regarding dependents

Hello
I have the following queries. I will be very grateful for advice on this.

Query 1-

I have a question regarding my family`s immigration status. I, along with my wife and my daughter moved to the UK in April 2018. I was on a student visa and my family as my dependents. My second daughter was born in the UK in Jan 2019. In July 2022, we switched to the global talent visa. As the rule states, I am eligible to apply for ILR in July 2025 I was endorsed by the British Academy. As I understand dependents should complete 5 years before they are eligible to apply for ILR. However, since my family has been continuously staying with me as dependents since 2018 on a student visa- will they be eligible to apply for ILR in 2025, the same time when I will be or will they have to complete 5 years on the global talent despite having been in the country for over 5 years. And will my UK-born daughter be able to apply for citizenship directly once I switch to ILR.

Query 2-
Is the priority option (15 days) available for ILR applicants with Global Talent Visa and the dependents as well?

1. You all can apply for ILR together. The GTV rules do not care what visa route they are under as long as your spouse spent 5 years as your dependant partner. The UK-born child does not need ILR and can be registered as British using form MN1 when one parent settles.

Very kind of you to respond back on my query. Could you please also advise that since when the continuous period is counted? Is it from the visa award date or the date of application?
It appears from the following link it could be date of application as well

So if we applied on 12th of May 2022 and got our visa on 12th of June 2022- in my case, can I count the continuous period of 3 years from the 12th of May 2022? and apply 28 days before the 12th of May 2025?

No. It is from the date of the first GTV visa approval. That old guide also does not apply to your route either !

Hello

I am writing to ask for some advice on the following. This is a great forum and thanks for all the help you offer.

Myself, my wife and one of daughters are eligible to apply for ILR this coming June. I have another daughter who was born in the UK so not ILR required for her once I get it.

Our visas expires on 12th of July 2025. We plan to launch our application sometime between 15th and 20th of June 2025.
The issue is that I am on global talent visa. If I understand correctly, I can only apply either for a normal service or superpriority service which costs £ 1000. Now, if i add my dependents on my application, does it mean I pay for super priority for them as well? Can their application be kept as normal?

or alternatively, is it possible that I launch my application and get a decision using superpriority and then later on apply for their ILR? Will their status be legal during the time my application is in process and they are still on GTV dependent?

or alternatively, we all apply for normal but what if our decision arrives after the 12th of July 2025, our visa expiry date? Will my daughter's status, who was born in the UK, will be legal? Although she was born in the UK but she is my dependent (GTV dependent) as has the same visa expiry data. If she does not need ILR will her status be legal while my application is in process or even if the decision is received after the 12th of July 2025- which is also her visa's expiry date.

I will be grateful for your clarification in regards to the above.

If you add dependents to your application, you have to pay super priority fee for each applicant.

They can apply separately, their decisions will be held until your application is decided.

Super priority is not guaranteed either.

Uk born child becomes an overstayer once the visa expires. No effect on registering the child as British but free nhs an issue, make sure you have private medical insurance.

Thank you very much. I would like to reiterate that this forum is very helpful.

This is what I am planning to do now.

I apply for my ILR- and hopefully if superpriority is available- I go for it.
On the same day, in fact, right after submitting my application, I submit two separate applications. One for my wife and one for my daughter.
They do not need to be on the same application as mine. By June, they would be on dependent visas since April 2018 so they can apply on their own, through their separate applications.

Will this be the right strategy? Please do advise.

To be honest- the reason I am double checking this is because we have been here since April 2018 and I just want everything to go without any complications.
If the above mentioned strategy is absolutely fine, I will go for it

You can add your daughter to your wife's application. No need for separate forms.

Note that they can't get ilr separately before you, just to clarify.

There is no rule that all applicants must apply at the same time or on the same form.

Please one last question. I understand that superpriority is not always available. Is priority even an option for GTV to ILR? I recall reading somewhere that you can either go for just normal or superpriority if it is available.

Sorry I forgot to put this question in my previous post.

And yes, I will put my daughter in wife's application. I will submit mine separately- hopefully with superpriority and normal for wife & daughter.

Note that you only need to submit an application before/by the expiry date of your current visa (12 July 2025), the response from UKVI can be given at any time even after that date with no issues. Beyond that date, your immigration status will be extended under section 3C until UKVI gives a decision.

There is no requirement to have a decision before your current visa expires.
