Reg: Eligibility to apply for ILR

Hello,

I first came to UK on Tier 2 (General Visa) on July 10, 2018. After July 10, 2020, I switched to PBS tier 2 dependant visa linked to my wife's tier 2 visa. Now in July 2025, my wife, on completing 5 years on her tier 2 visa has applied just now for her ILR. I read online on the UKVI website that, you need to complete 5 years continuously on tier 2 visa to become eligible for applying for ILR. So, since I switched my visas, am I eligible to apply for ILR now since I completed totally 7 years now in UK.

Hello,

Kindly give a response to my above query. Based on the response of my above query, I have another query. Currently, if my wife gets ILR status, can I get a COS from her employer to extend my dependant visa or do I need to switch over from tier 2 dependant to Spouse Visa? Because switching over to Spouse visa may reset my ILR eligibility clock to another 5 years :( .

If you've been her dependant since 10 July 2020, you're already eligible for ILR under this route (10 July 2020 + 5 years - 28 days), provided you meet all the other requirements.

You don't need anything from her employer to apply. No need to switch to spouse visa either.

Tier 2 route does not exist any more.
You will be eligible for ILR within 28 days of competing your 5 years as a dependant. You do not need to extend or switch at all.
