ILR eligibility of kids

Hi everyone,

I would appreciate some advice regarding my children’s eligibility to apply for ILR.

I have been on a Skilled Worker visa since January 2021, and my two children have been my dependants on this visa since the same date. My wife was initially on a Tier 4 visa and switched to a Skilled Worker dependant visa in December 2021.

By January 2026, my children and I will have completed five years under the Skilled Worker route. However, my wife will need one more year to complete her qualifying period.

Can I apply for ILR for my children at the same time as I apply for mine, even though my wife is not yet eligible?

No you cannot. The rules dont allow it. Your children will qualify for ILR when your wife does.
