Hi,

I am thinking of applying for ILR for my kids ages 8 and 4
Me and my wife have ILR , I came to uk on tier 2 and my family as dependant

My question is whether to use SET(O) or SET(F)

We think it should be SET(O) , however suggestions online are a bit confusing including the guidance on gov.uk.

Please help . Thanks

Kids born outside UK

Cheers.
Pk

The children should have settled with you (the parents) and included in the SET(O).
But SET(O) is only for adult applicants. Now SET(F) is the appropriate application for each child

Thanks for your reply.
I have started looking at both set(O) and set (F), I was able to apply for kids in both.

As per my understanding, since I was settled in the UK via the skilled worker route, it is SET(O) the correct one.

Does anyone have any similar experiences where kids ILR applications were applied later once parents were granted ILR.

The route you applied to settle is irrelevant when it comes to children. They can settle when the parents are settled but how the parents settled is irrelevant. As advised, you also cannot apply for a child on their own using form SET(O), they can only be included alongside the main adult applicant. The whole point of form SET(F) is to allow children to settle on their own. This is basic common immigration knowledge
