ILR 5 year qualifying period for skilled worker dependents

I was on a full time PhD student (Tier 4 visa). My partner and two children living with me in the UK as PBS dependents. I then got a job and switched to Skilled worker visa in June 2022 but my partner and children switched to Skilled worker dependant visa in June 2023.

I have a question

Since I will be eligible to apply for ILR in May 2027, will they be eligible to apply for ILR at the same time as me - not sure if their stay from June 2022 to June 2023 be counted for the 5-year ILR requirement?

Appreciate any advice/clarification or if anyone had the same circumstances?

The rules do NOT care about the route of dependants, so your spouse only needs to have been your dependant partner for 5 years. They will all settle with you

Sorry for the typo in my post - my partner and children came to the the UK as Tier 4 (student) dependent visa not PBS dependent.

The reason why I asked is I had a chance to discuss with one of the solicitors assigned by Citizen Advisor and he told me the time my partner/kids stayed in the UK under Tier 4 (student) dependent visa before June 2023 is not included in 5-year residency period and they are not eligible to apply for ILR until May/June 2028.

The advisor is wrong. Time spent under any dependant route counts
