Hi Guys - new to the site and was wondering if yu can maybe shed some light on my situation. I am a Non-EU passport holder (South African) and my husband has a British Passport.
Whe will be married for 2 years in March and I am due to apply for my ILR then....but here's the kicker...we have seperated and have been living apart for 6 months....!!
Does anyone know what the rules are? He agreed to still help me with my application but I just wanted to know if anyone has experienced this or heard of someone who might've been here before...?
I am very confused and don't know what to do, dont want us to move back in together just for the sake of a visa, I would prefer for us to work this out in our own time - hate to be rushed due to timing...
PLEASE HELP?

this is quite problematic. If you apply for the visa and if the UKBA find out, you could be accused of deception and deported. I am not encouraging deception but there is little other option for you. Other methods will take at least 5 years to get an ILR. The UKBA may investigate and if they find out that your adress is different to that of your ex then it could mean trouble.
To have done this properly, you should have informed the UKBA when relationship broke down (
http://www.ukba.homeoffice.gov.uk/partn ... nshipends/) and they would have curtailed your visa unless you had like children or other compassionate reasons.
I am only telling you the risks and information. It is up to you to decide what to do.
