ILR under 2 Judicial Reviews (2008 & 2009)

Hello to everyone!

There are a number of helpful postings here about applying for ILR under the latest JR 2009 (4 years' residence instead of 5 for those who applied before 03 Apr 2006). However, I could not find anything on applying under both Judicial Reviews, including that from April 2008 that re-instated people with HSMP who lost their status due to rules changing on 07 Nov 2006.

Those who could not extend their 1-year HSMP visa after Nov 2006, but later reinstated, have the entire "out of status" period made eligible for ILR purposes by that JR. Also, their 4 years of qualifying period started being completed just about now, so it would be interesting to hear any first-hand experience on how those applications were processed - especially if anyone tried applying via the premium service at PEO, and whether the caseworker agreed to accept it as a straightforward application.

I've spoken to the UKBA customer equiry team on the phone -- they said there is nothing to prohibit such application from being considered, but whether or not the individual caseworker will accept any given application as straightforward or pass it on into "offline" review is really up to them.

So any first-hand experience from the fornt lines would really be appreciated - both successful and those who were not processed on the same day. May help us save an unnecessary trip to PEO and the premium pay involved...
