HI All,
I got my Initial HSMP Visa in March 2006. and got extended under TIER1 general in march 2008 for 3 years until march 2011.
Now i am planning to apply for ILR in this march(2010) under the new judiciary rules( 4 years PR). But i have been outside the UK in 2006 under HSMP for 105 days continously from sep 06-dec06 and more than 200 days outside overall in the last four years. But for 2006 i have a letter from my UK employer that i went to india on training for 3.5 months..
My question is -is it better to apply for ILR this march or can i
WAIT until december this year so that i can then match the continous stay in the UK ? is the second option valid as my present tier1 visa is valid until march 2011.
Many Thanks

if you were paid in the UK and paying tax and NI then you can apply in March.
in any case i'd call a PEO and asked. they were very helfull with getting my date correct so i don't apply before 28 days before arrival (not visa issue date)

Thanks for the reply kamalin. No i did not get paid in the uk for that 3.5 days, but i got the company letter saying that it is a business travel.
But still, if the home office do not consider it to be continuious stay, can i
wait unitl this december and then apply for the ILR as my visa is valid till march next year.. Will i meet the 4 years continuous stay in this case then ?

call UKBA. if they can't tell you you can risk and go to PEO in March or pay solicitor to insure secure case.
if you take the risk pick the PEO that reviews the documents before you paid. at Croydon you pay and then get checked i think.
do more search on the forum.

ok i heard that solihill PEO does not charge initially. But one question is, suppose without taking risk, can i wait until this december and then apply for ILR so that i can prove my 4 years continuity from December 2006(date when i came from my 3.5 months break) to December 2010..
Thanks

why not?
people with gaps have to extend their stay to make up missed time.
your visa is covering additional required period.
i'm on the similar dates with you but my entry clearance under HSMP was for 1 year when yours was for 2. i'm not sure why.
they started giving 2 years visas only after 5 years introduction.
check your documents - you might not be qualified for HSMP JR

Thanks for the reply kamalin10, in this case, do i have to wait until december or can i just make up those 2 weeks in this april and then apply for my ILR ?
Regarding HSMP JR , I am definitely eligible for it as i got my intial HSMP
in March 2006 but i got it stampled on april 6th. Anybody who got thier approval or even if they applied before prior april 2006 and got the visa
any time are eligible under HSMP JR..

Can i ask regarding about ILR form. The 2nd page ask you to fill in payment detail, if you are attending the appointment in person do you still need to fill in this section? i thought payment for appointment is made through the card machine?
