Hi,

I have had a look at http://www.ukba.homeoffice.gov.uk/polic ... es/part6a/

but there are certain absence and entry rules i want to be clear which the link doesn't mention?

My visa status is tier 1 general(extension):

HSMP visa: 8th Jan 2008
Tier 1 General extension: 8th Jan 2010
Entry in UK: 4th Feb 2008

Can somebody tell me for ILR, do I qualifiy the within 28 days period entry as it is exactly on the 28 day that i entered?

My partner is planning to go on holiday for more than 3 months, is she ok or does she have to go for less than 90 days?

Can somebody point me to the exact days for entry and also absence quidance as even in year 2008 i was out of Uk for more than 90 days??

Regards,
uiqbal

If your date of entry in UK is 04 Feb 2008, then you'll qualify for ILR on 04 Feb 2013 (assuming current rules do not change before then). The earliest date you can make an ILR application is 07 Jan 2013.

See ILR Processing: A CaseWorker's Guide/Manual
Also see Standard requirements for naturalisation

Hi,
Thanks for clarification. Can you please clear the dependent query as well?

My partner is planning to go on holiday for more than 3 months, is she ok or does she have to go for less than 90 days?

Or to rephrase the question, are the rules same for tier 1 general dependent?

Requirements for naturalisation if you are married to or the civil partner of a British citizen

Not sure if this is applicable only to people who enter UK on a spouse (of a settled person / citizen) visa or is also applicable to those who enter UK as dependents of someone with limited leave to enter / remain and later qualify for ILR / naturalisation (e.g.- Tier 1 / HSMP etc.).

In my personal opinion, if you can avoid the long absences then you should ... to be on a safe side.

regards
