ILR and Break

Hi,

I Tier 1 immigrant but used to be on work permit, my immigration history:

January 2006 to December 2007 : WORK PERMIT

December 2007 : Changed the job > new company failed to get in-country permit (due to non advertisement of job)

December 2007 to 18 January 2008 : CURTAILED WORK PERMIT FLR

18 January to 25 February 2008 : NO RESIDENCY STATUS (but had applied for FLR therefore passport was with HO)

25 February to 15 March 2008: Packed up and left UK to facilitate out-country work permit.

1 JULY 2008: New Visa based on new work permit

1 JULY to date: continuous residency based on work permit and from 25 JULY 2009 tier 1

I have a continuous gap of 5 month due to failure of company to advertise the job and this is strengthened by a letter by new work permit (that also state harshness of HO while dealing with my application) arranger.

I would like to give ILR application a go but would like to ask how realistic it would be to assume it is an intelligent go.

Not sure HO will buy this. your company, your job, your pay ... it's YOUR problem .. isn't it?
If you were stuck in UK , if it was stuck with HO then it would make sense ... then it would still make a case ... but when you leave country ..it might be difficult.
Someone in your company did not follow the rules and hence delay .. do you think it is HO problem or comes under exception situation? ... this is what you will be thinking .. and this is what case worker will think ... outcome ... you never know ... but it might be worth trying if you ready to part with some of your cash.

Sounds very tough to get ILR due to the long absence. My answer would be no but do seek professional help before making a decision.
