ILR FOR MORE THAN 90 DAYS

I got rejected ilr for leave being more than 90 days in one stretch,i hv
lodged an appeal,I hv heard clock resets if u spend more than 90
days(unfortunately I could not send letter from employer initially with application),I am going to prove that 2months were for business related leave.
Now if my appeal hearing comes after 31st May,then I am going to complete
continuous 5yrs even if i start counting after that leave.
can seniors members pls guide me if I can include This as one extra point in my favor?

your "legal" stay in the country ends the day decision is made (unless your visa was not revoked or you still have leave left on current visa). if you disagree with the decision, then you can appeal. the time you spent while appealing, in my opinion, is irrelevant for ilr purposes.* i am going by the assumption that your leave has expired.(
if you are very sure about clock being resetted once you were out of country for 90 days then i suppose you have no option but to appeal.
can you show 5 years of continuous stay in uk AFTER you were out of uk for 90 days now? if yes, then make a fresh application.
too little info provided regarding your current leave etc. so not in a position to advise you any better than that

Thanks for prompt reply,i was thinking if as i am allowed to work during
appeal period then may b this time i can include and try to point out this one?
but is it advisable to show these facts during appeal instead of making new application?(to be cost effective) what u suggest?
