Hi,

I came to UK in a work permit on July 31st 2005 and I am completing my 5th year this July. But when I came here on July 2005, I went back to my country on Nov 2005 by SUBMITTING P85 and came back for a new project on Jan 2006. Can you kindly let me know if I will be eligible to apply for PR this July?

Also, I switched from work permit to Tier 1 general during 2008 and I am currently in Tier1 general Visa.

P85 is to claim (excess) tax paid when one intends to leave the UK for good / with no intention of returning in the near future. Therefore the period between Nov05-Jan06 could be considered as a break in residency in the UK.

Why not wait till Jan 2011?
