Urgent ILR Query - Spouse ILR, Child UK Citizenship

Hello everybody,

I have a few queries regarding the ILR application I am about to make next month (4yrs 11months this June):

- What is the time period requirement to have lived in the UK before a dependant on the Tier-1 visa (spouse) can apply for ILR?

- What happens to my wife's visa status when I apply for my ILR? (applying next month)
- Can I add her to my ILR application (thinking of premium service)?
- She has been in this country for 15 months on a Tier-1 dependent visa and it has been 17 months since our marriage.
- What visa form should I apply for her?
- Do I apply after I get my ILR or submit her application at the same time as mine?


Also we are looking to start a family but the spouse feels it best if we had the child delivered outside the UK.
- Is my child eligible for UK citizenship if born outside the UK and at the time of birth I am settled in the UK? (My wife does not have ILR or UK citizenship)

2 years as a dependent of Tier 1 migrant.

If (and after) you are granted ILR, she will have to apply for extension of stay using the form FLR(M).

Only if she has completed 2 years in UK as your dependent (which she hasn't - yet).
