Hi

I came this country on student visa on sep 2003 and completed my study and got psw which is going to finish on next year (2011), currently my wife is on my dependent but she is applying to university for 3 years student visa for degree course next year, if she gets 3 years students visa next year, if i swith to her dependent visa next year so can i apply ILR on sept 2013 (10 years continous stay). i know rules are changing next year for ILR, it would be provisional ILR but my question is;

Can i apply ILR on sept 2013 as dependent of my wife because i will be completing 10years stay,

can my wife switch to my dependent after once if i get provisonal ILR on sept 2013.

thanks in advance

Nil

1. Yes, If the 10yr long residence based settlement scheme remains operative under the new government / earned citizenship laws.
2. Yes, if the new rules allow. So, a degree of uncertainity exists.
