Not aware of Changes in ILR 2011

Hi,

I had my HSMP in August 2006 for 2 years, in august 2008 I had a swtich over for extension under Tier1 and now in August 2011 this will expire. Am I still eligible to apply for ILR? could you please enlighten me with new regulations that are anticipated? I would also like to know required documents I neet to provide.

Please guide me.

No one knows. If Govt wants to implement new citizenship bill, than they will set the critria of getting Probationary Citizenship. (There is no info available about new critira.)

In next few weeks/month some info will be available on this topic.

The changes are meant to happen in July 2011 so you may or may not slip through.

The changes are meant to happen in July 2011 so you may or may not slip through.
The changes (July 2011 laws) were not meant for HSMP migrants prior to November 2006. Hence, this does not affect HSMP immigrants prior to Nov 2006 but will affect any immigrant post Nov 2006.

I hope this clarifies.

If anyone has any queries, please refer UKBA HSMP pre Nov 2006 guidelines.

Thank you for your response. I am unable to locate Pre November guidlines. Please help me locate.

Also if you have any idea when it will be definate announcement of this July 2011 changes?

cannot you apply for ILR i august 2010? as you initially entered in UK on hsmp prior to nov 2006. not sure though.

I called UKBA direct and the agent specifically mentioned that no one is aware of this change and it is part of a rumour. Also Pre Nov will not be affected with any changes.

What a relief!

Under the old government, the transitional arrangments stated below were planned (they used to be on the UKBIA website). I guess with the new government you will just have to watch he developments in due: course

The Borders, Citizenship and Immigration Act received Royal Assent on 21 July 2009.

Sections 39-41 and 47-49 of Part 2 of the Act give effect to earned citizenship, which is planned for introduction in July 2011.

As the Borders, Citizenship and Immigration Bill progressed through Parliament, the government listened to the views of both the House of Lords and the House of Commons.

The government subsequently agreed the following transitional arrangements:

•If a migrant has already been given indefinite leave to remain (ILR – also known as settlement) on the date when earned citizenship is introduced, they will automatically be considered to be a ‘permanent resident’. They will not need to pay or apply for this to occur. They will be eligible to apply for British citizenship under the current rules during the first two years after earned citizenship is introduced.
•If a migrant has applied for indefinite leave to remain before the date when earned citizenship is introduced, and is subsequently granted indefinite leave to remain, they will be eligible to apply for British citizenship under the current rules during the first two years after earned citizenship is introduced.
•The government will continue to meet its obligations to migrants who entered the United Kingdom on the Highly Skilled Migrant Programme (HSMP) and had a legitimate expectation that they would be able to apply for and be granted indefinite leave to remain, in accordance with the Immigration Rules that were in place when they applied to the HSMP.
•The introduction of earned citizenship has been postponed by six months, to give people time to adjust to the new system and to allow more applicants who are already in the United Kingdom to apply under the current rules. Earned citizenship will now be introduced in July 2011.
All applications for indefinite leave to remain and British citizenship received before earned citizenship is introduced will be dealt with under the current system.

Cf_firefly - thanks for your link to the pre Nov 2006 HSMP rules.
Do you or anyone else know if the same rule applies to Work permit holders as well if their permit was approved+stamped during the same period?

Hi,
I have submitted my application for HSMP before Nov 2006 but got approval on 22 Nov 2006.
So, will the new rules from July 2011 affect my ILR.

How about person on WP (Before Nov 2006) - I came to UK by 1st Aug 2006 (on WP till Dec 2008 + Shifted WP to UK employer (Sep 2008 till Dec 2009) + Shifted to Tier1 Valid from Dec 2009 till Dec 2012.

Will I be eligible to apply for ILR?

Due4ILR- Under curent rules you would be able to apply 28 days before 5 years of residence - presumably sometimes in July 2011.

If the rules will not be changed by then you should be fine. No one knows yet if and when the rules will be changed but it is probable that they will change and probably around that time (July 2011) as the tories are keen to change the current settlement regim.

You just have to wait and follow the forum and UKBA website for announcments.

I got my approval Letter on 06-july-2006, as described on this link, i should fall under this category, i go through SET(0) form but could not find any category, in this form they have mentioned the category "the HSMP ILR judicial review policy document" but its for those who applied before 3 april

any idea guys

hey guys,
i am in the same boar of pre nov 2006, but can any one tell me about the form SET(O), there is no option of HSMP PRE NOV 2006, its only for HSMP PRE APRIL 2006.
Which option we have to select in SECTION 3.

plz let me know, if anyone knows the answer.

Sorry if this is a thick question or been asked before but this matter of the "probationary citizenship"?

Will it apply to everyone? Including those who are going via the Spousal/Dependant route?
