P60 Missing

Dear Friends,
I would be eligible for ILR on 2012 December,I dont have P60 for year 2008/2009,my company is not giving me the same.I am not sure whether they paid tax or not.So can I apply for ILR on 2012 with 3 P60s ? that is 2009/2010 , 2010/2011,2011,2012 ?
This is the summary
1. Landed on 20th Jan 2008 on work permit
2. Tier 1 in Apr 2010 and expires on Apr 2013.
Are Bank statements / Payslips sufficient ? please let me know the alternative.
