Gap in Stay in the UK - more than 3 months

Hi,

I have stayed in the UK for the first time on 16th September 2005 and went back to India on 25th November 2005 on a Workpermit.

I came back again on the same work permit on 1st March 2006 and have been staying in the UK until now. I have changed my visa to HSMP on 08th September 2006.

The gap in between my 1st stay and 2nd stay is exactly 94 days (days away from UK).

Am I eligible for Indefinite Leave to Remain based on my entry date of 16th September 2005? Or beacuse I was away from UK for more than 90 days after my first visit, I cant apply?

Either too busy or not willing to answer the question which you yourself have answered in subject line :)....a gap of more than 90 days at a stretch is not acceptable when applying for ILR..

However, if you can prove that gap of 94 days was due to business purpose or work related and get appropriate letter then you should be fine.

Thanks for the reply. I was kind of doubtful, but now its clarified.
