what date apply for ilr

i came in uk at 6 nov 2009 and my spouse visa expire date is 28 jan 2012,when i be able to apply ilr ,thanks

No earlier than
28 days before 06-Nov-2011.

but visa is valid till 28 jan 2012,so why apply ilr before nov 2011,can some one please explain me,thanks

In an effort to become a permanent resident at the earliest opportunity.
It is your choice as to when you want to apply - at the earliest opportunity (as in response above) or at the last moment (expiry date of your current leave), or anytime in between.

according to the new rules set by the old government I thought after july 2011 one has to apply for a probation citizenship (in case the rules will be applied by the new government) ..

Whatever the term...ILR or Probationary Citizenship, the application date will remain the same. There's been no confirmation yet whether the present government will implement the new Regulations.
