Getting tired of waiting - Settlement.

Hi,
I applied for ILR (10years long residence). The Home Office refused it saying that I had a visa gap. I appealed and lost. A reconsideration was ordered and the SIJ said that there wasnt an error of law.
I applied for permission to appeal to the Court of Appeal. Permission to appeal was granted on the 30th of August. The Lord Justice that granted the permission recommended that the Home Office consider granting the ILR outside the rules.
I wrote to the Home Office on the 3rd of Sept asking them to settle the matter i.e. grant the visa to save time and costs.
The Court of Appeal extended the time that I had to file my paperwork and the hearing fee to give us time to settle the matter.
Anyway the Home Office have not replied to the letters. My extension to file is expiring next week. I have been told I can ask for it to be extended again. I have consulted some lawyers and they are saying I should give the Home Office more time.
My question is has anyway else had a similar situation were the Treasury Solicitors seem to ignore correspondence and judicial recommendations to settle a case?
I am tempted to just file the stuff required as my hearby date for the hearing is in November. At least that way I am guaranted a resolution, instead of waiting and waiting. I wait for the postman everyday hoping there is a letter from the Tsols. Should I conclude that because they havent replied they dont want to settle?
