Hi everyone

I need your help with this query. On October 7th I applied for ILR with my husband and daughter as dependents and was successful. My daughter was born in the UK in 2009 and I have now realised that she did not need ILR!!!

Is it too late to get a refund on her fee from UKBA? IF yes, where should I send the letter?

Has this happened to anyone else before and were you able to reclaim the fee.

UK-born-child(ren) may be included in parents' ILR application, though there may be no need for it (depending on future intentions). It is not that they cannot / must not be included in the ILR application.

e.g. - when the parents(s) are of the opinion that the child(ren) should not acquire British citizenship (for the time being, for some reason) but should live in the UK on settled status, then UK-born-child(ren) need to be included in the parent(s)'s ILR application.

Therefore, the choice is with parent(s) to decide what option to take. Hence no grounds for refund, IMHO.

I agree with Sush, no chance of a refund. it was your choice (even though you didnt know about it at the time...)
