HI ALL,

Can any budy tell that every one mentioned in form the dates you were outside UK for holidays paid or unpaid etc...

If you have your ILR in 2010 suppose and you were on holidays in 2008 or 2009 and it was paid ?

How do you justify this..... do u provide that MONTH/YEAR bankstatement to show money comes in and is paid holidays ?

How HO know that in 2008 you had paid holidays ????

What docs you provide to prove 2 years back your holidays were paid holidays ?

Just do a time line of your absences from UK, as accurately you can remember or confirm from your passport stamps.It is important to list separately any absences which were related to your work, these may not be counted towards your personal absences.
You do not need any evidence regarding paid or unpaid leave.

paid leave means it was work related.... how HO know it was paid leave ?
may be it was your personal leave and u declare as paid leave....my question was how the HO know it was paid leave so that they dont count

You have to give a letter from employer, stating duration and reason of absence,if you are claiming any official leave. HO may check this from your employer.

really strange for me..

u came on HSMP and 1st year u work for ABC company and u leave after 1 year..

then when applying for ILR you will go back to your 4 year old employer and ask him to give you letter that your holidays were paid holidays.....

i think i should provide payslips instead of that time ..

You can take your chances but if its work related leave and youre exceeding the limit of 180 days , then evidence will be good for you.

No paid leave means paid leave either for holidays (as paid vacation) or business trip (in which case its not a "leave")

Its all down to ur luck as to what they will ask you regarding holidays. Fill in the form accurately and correctly. Get as much evidence as you can and hope for the best. more evidence the better (specially a letter from employer re paid leave / business trip. second option is payslips / bank statements...

u rright... i will try to provide bankstatments and payslips... i cant ask employer 3 years old to provide me letter etc.... i kno wits on luck.. but hwat i'm trying that i can provide as much as evidence that if they refuse i will have strong case to fight in court.

If you leave the job, or ur job finished they will pay u remainign holiday pay and etc ....
and if u go out of UK after that and payments comes in as your remaining holiday money will it count as Holidays PAID leave or what ?

I left my job in march and went to holidays and my remaining holidays payment they pay in April. so wil that money count as paid holiday money ?

do you have payslips for this period? if so then yes.

yes i have i think .... and if not all then i will show bankstatment... will it work ?

mean 6 monhts absence out of 1 month was holiday paid leave ....

one technical question

if HSMP year started from january to december....

and if you out from mid october till mid of april. it means 6 months.
but in 2 HSMP years are included in that absence.

My situation is same. So can i put absence like this that one 1st year of HSMP i was out for 2 1/2 monhts and 2nd year i was out for 3 1/2 ... which makes 6 monhts consecutive.

any idea ????

because rule say you shouldnt be out more than 3 months in one year ... that one year is HSMP one year ....
