FLR(M) or SET(M)?

Hi and thanks for helping.

I am currently on a Tier 1 General visa which is due to expire in Jun 2012. I married my husband who had a work permit in June 2008 with a COA(Certificate of Approval) in london. Thus we have been married for 2.5 years. He has applied and successfully been granted an ILR last month.

Can I apply for ILR as his wife even if I am not his dependant?: SET(M)
Or do I apply for a spouse visa FLR(M) and apply for ILR after 2 years?

English language requirement for partners applies.

If you are eligible for settlement (in your own right) within the next 2 years, then no point in changing status.

Thanks for your reply.

Unfortunately, I got my Tier 1 visa just last year for 3 years.
In 2012 I would have to apply for an extension.
So in order to apply for ILR on that basis, I would have to wait for another 4 years.

Therefore, considering changing my visa status to spouse of ILR or ILR(if possible). Thereofre the question SET(M) or FLR(M).

Thank you for the information about the neglish langugage, I have an old NARIC letter as well as a UK Masters degree for that.
