I would greatly appreciate if I could get any advice on the couple of issues below.

1. I intend to attend a face-to-face interview for the ILR application tomorrow. I have held a work permit for the last 5 years and possess the necessary documents.

2. My wife has been in the UK for 3 years. She holds a HSMP tier 1 work permit. Can I be allowed to put her on my application as a dependent?


3. I have a six month old Daughter who was born in the UK. She holds a foreign passport. She has not been out of the country yet. She does not have a visa in her passport. The question is, will I need to put her on my ILR application too before taking advantage of section 1.3 (registering her as a British Citizen once I attain the “settledâ€

1. There's no question.
2. No.
3. No. After you are granted settlement, apply for registration under section 1(3).

Indeed number 1 wasn't a question.

I was at at the home office (HO) yesterday (I wrongly counted my days from the day my leave would expire, rather than the day I would have spent 5 years in the country...stupid mistake I know) and the HO staff I spoke to gave me contrary info with regards to your answer to my question 3. That I found quite baffling and he followed that up that if I didn't do it when making my application, I would have to pay another £800 for my Daughter later on.

I believe that HO staff is mistaken.

Thought I post my experience at the Home Office. Eventually got my ILR. Had to get same for my daughter too who was born in this country. The Public Enquiry Office (PEO) staff I dealt with said that although she was born in the country, she had to be brought inline with my immigration status before I could register her as a British national(I guess section 1(3) of the british nationality can be considered vague in this regard then!).

As already mentioned by Vinny, you were given inaccurate advice by the UKBA staff.
