ILR Questions - Please help

All,

I would be appearing for my ILR appointment next week. However I after reading quite a few posts on this board, I have some doubts about my application. I would appreciate if members could advice.

I came to UK in Mar 2006 on WP and worked for an outsourcing company on an allowance model. I later got HSMP and decided to go contracting. Issues below:

1) I do not have a P60 for Salary/allowance from Apr 2006 to Mar 2007. I have tried the letter from HMRC as well and it does not mention anything either for that year. I do however have some payslips and bank statements for the period. Is this an issue still?

2) I got HSMP in Oct 2007 and I resigned from the company. However I did not get P45 as I was asked to go back to home country. I went back in Oct 2007. Does this create a problem?

3) After completing notice period of a month, I was back in UK after being out for 37 days, looking for job. How do I classify this period?

Would appreciate help / guidance from members.

I have noticed few folks have got ILR without having all 5 Years P-60 so you might be okay as they can check this detail from your NI ( this means you might have to stay longer at PEO while they are checking ).

37days shouldn't be an issue as they check you should be working 3-6 months before applying ( by the way most of the contractors are not always working they do get some gap to get a new contract so you should be okay).

Please try to take all payslips , bank statements etc to cover yourself ..

I am quite confused about an issue about my absences from UK and have had to delay my application.

As mentioned earlier, I was working at a client site in UK, hence any holidays back to India would mean that I would not be paid UK allowance but only the Indian pay. Would these be considered as paid holidays ?

Also I got my HSMP in Sept 2007 (I was on WP since my arrival) and went back to India in Oct 2007 to complete resignation formalities (Notice period 3 months starting Oct 2007). I took holidays for 2 months and was back in UK in Nov 2007 to look for a job. However went back to India mid dec 2007 for final settlement and returned to UK, after completing resignation formalities in Jan 2008. I got a job in Feb 2008 and have been contracting since.

To summarize, absences from UK:
Assignment ends 28th Oct 2008
29th Oct 2007 to 10th Nov 2007 - India
10th Dec 2007 to 17th Jan 2008 - India
Back in a job in UK - 10th Feb 2008.

Bear in mind I was on HSMP visa during this period. Does this create an issue for my ILR and rest my 5 year clock? Request seniors - sushdmehta, chetan, xyz, rajathwp, vinny, john etc to provide guidance
