Hi

Could you please advise how to proceed with ILR, I came UK 45 days late after my Visa Stamped (Got 5 years work permit). Now I am 45 days short to qualify to apply ILR.

Visa valid form 18/04/2007 to 18/04/2012
First Entry to UK 30/05/2007

5 Years will be completed on 30/05/2012 but my visa expires on 18/04/2012.

Please advise how proceed
1. Tier 2 with new sponserchip certificate
2. Can i Directly apply ILR before 45 days by post, do UKBA refuse my application

Hi,

Tier 2 migrants:
You can count the period between the migrant being granted entry clearance and the date they entered the UK towards the five year period providing it is no longer than three months.

Please check the link below..

http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary

Since you came 45 days late, I think it wont be a problem with your case..

Thanks for the help.

Please advise, I can apply for ILR before 28 days of 5 years period, but my VISA expires 43 days before qualifying period.
