ILR case

Hi
Someone has posted the link before in another topic:

After checking my eligblity for ILR in the future, I found I could not qualify. May you please let me know if I did the calculations correct:
work permit : 2008
initial Tier 1 : 2009, age:29, salary:£26,000, qualifications: PhD
second Tier1 : to apply in 2012 assuming £26, 000 salary
ILR : to apply in 2013 assuming £26, 000 salary
according to table 3 (page 6) in the link above, I can socre 65 points. But the documnet says I should score 80
May you please let me know if my calculations are correct or wrong.

75 points from Table 2, assuming no further changes until the day you apply (2013).

Why I should use table 2 I thought becuase my tier 1 extension will be in 2012, the rules for applications after 19 July 2010 should apply to me?
what does it means when they say " Tier 1 (General) Migrant under the rules in place before 6 April 2010,
and has not been granted leave in any categories other than these since 6 April 2010"?

that means that you got Tier 1 before April 2010 and have not changed visa status to other categories e.g. work permit. Its ok if you have an extension but if you change visa category then your application will not be considered under above mentioned rules for Tier 1 applications prior to April 2010.

Many thanks xyz123. It is getting clearer now. I was thinking that my future tier 1 extension will shift me to the rules for Tier 1 applications after April 2010.
The date of the initial Tier 1 application is, therefore, important for ILR and not the date of Tier 1 extension.
