Queries regarding driving offence and co-habitation

Dear Seniors:

I have an urgent questions for my upcoming ILR:

1- I have had a driving offence( using mobile phone while driving ) more than 4 years ago: and as far as I know it was spent offence, do I need to mention it in my application or not....
2-co-habitation evidence: I am applying with my wife for ILR and I have some bills with both our names together and others for her and mine separatly, however they do not cover each month of the last two years, there are few months gap here and there where I do not have evidence.
is that will be a problem.

1. What the driving offence (code)? Were you convicted in court?
2. What is your current immigration category?

thax for rapid reply

the code of the offence is CU 80 fixed penality 60 pounds and 3 points on liscence NOT trough court.
my Immigration category is WP+HSMP+Tier 1

2. Your wife doesn't need to prove co-habitation in the same way as those applying for settlement under SET(M) route are required to. And even for applicants under that category, it is not required to provide documentary evidence to cover "every single month" of the qualifying residential period.
